By using MyEMemorial, creating a memorial, or purchasing a plan, you agree to these Terms of Service.
2. Description of Service
MyEMemorial provides a platform for creating and sharing digital memorials, including photos, videos, written tributes, and other personal content.
3. User Content
You retain ownership of all content you upload. By submitting content, you grant MyEMemorial a non-exclusive license to store, display, and distribute that content on the platform.
You agree that you have the legal right to upload all content and that it does not violate any laws or third-party rights.
4. Payments, Refunds, and Chargebacks
All payments are processed securely through a third-party provider.
All payments are final and non-refundable, except where required by law.
By purchasing a memorial plan, you agree that:
- You are responsible for reviewing plan details before purchase
- Unauthorized or fraudulent use of payment methods is prohibited
In the event of a chargeback or payment dispute:
- MyEMemorial may suspend or remove the associated memorial
- Access to the account may be restricted
- Additional actions may be taken to recover losses
Memorials may be unpublished or removed if payment is reversed, disputed, or not successfully completed.
5. Video Hosting and Usage Limits
MyEMemorial includes video hosting and streaming as part of its service. Due to the cost of delivering video content, memorials that generate unusually high traffic or streaming usage may be subject to additional limitations.
MyEMemorial reserves the right to:
- Limit video playback
- Temporarily disable videos
- Require an upgraded hosting plan
6. Prohibited Use
You may not use MyEMemorial to upload or share content that:
- Is unlawful, abusive, or harmful
- Infringes on the rights of others
- Contains nudity, sexually explicit material, or vulgar content
- Promotes hate, violence, or harassment
- Is misleading or deceptive
MyEMemorial reserves the right to remove content that violates these rules at its sole discretion.
7. Memorial Ownership and Control
The account holder who creates a memorial controls its content and contributor access. Contributors may submit content, but the owner must approve it before it appears publicly.
8. Termination
MyEMemorial may remove or restrict access to content or accounts that violate these Terms.
9. Disclaimer of Warranties
The service is provided “as is” without warranties of any kind, including availability or uninterrupted access.
10. Limitation of Liability
MyEMemorial is not liable for any damages resulting from use of the service, including data loss, service interruptions, or user-generated content.
11. Changes to Terms
These Terms may be updated from time to time. Continued use of the service means you accept the updated Terms.
