Content Removal Policy

1. Content Review and Removal Requests

MyEMemorial allows memorial owners, contributors, family members, legal representatives, and other concerned parties to request review of content that may violate our Terms of Service, the rights of another person, or applicable law.

You may request review of content that you believe is:

• Inaccurate, materially misleading, or fraudulent
• Unauthorized or impersonating another person
• Abusive, threatening, harassing, or hateful
• Violating privacy or publicity rights
• Publishing sensitive personal information improperly
• Defamatory or intentionally deceptive
• Sexually explicit, obscene, or otherwise prohibited
• Violating another person's legal rights
• Associated with a fraudulent or unauthorized memorial

2. Memorial Ownership and Authority Disputes

If you believe a memorial was created without proper authority, is controlled by someone who is not authorized to manage it, or involves a dispute among family members, an estate, executor, legal representative, or other interested party, you may request review.

MyEMemorial may request documentation or other information reasonably necessary to verify identity, relationship, legal authority, memorial ownership, or the basis for the request.

MyEMemorial does not determine inheritance rights, probate disputes, executor authority, or other legal disputes between competing parties. Where appropriate, content or account changes may be temporarily restricted while the parties resolve the dispute or provide sufficient documentation.

3. Privacy and Personal Information

You may request review of content that you believe improperly discloses your private, sensitive, or personally identifying information.

Requests should identify the specific information at issue, where it appears on MyEMemorial, and why you believe its publication is unauthorized, harmful, or unlawful.

Removal decisions may depend on memorial ownership, consent, legitimate family or historical use, applicable law, and the rights of other individuals.

4. Copyright Complaints

Copyright infringement complaints are handled separately under MyEMemorial's Copyright and DMCA Policy.

If you believe photographs, videos, written material, music, or other content available through MyEMemorial infringes your copyright, please submit your complaint through our Copyright and DMCA Policy.

Copyright complaints should be sent to the designated DMCA agent identified on that page and should include the information required for a valid copyright notice.

5. Nonconsensual Intimate Images

MyEMemorial prohibits the posting of nonconsensual intimate images, including qualifying intimate images that have been digitally created or altered.

If you or a person you are authorized to represent appears in an intimate image posted on MyEMemorial without consent, please contact us immediately and clearly identify the request as an intimate-image removal request.

Please provide information reasonably sufficient to identify the person depicted, locate the material, and allow MyEMemorial to evaluate and process the request.

MyEMemorial will process valid removal requests in accordance with applicable law and, where legally required, remove qualifying content and known identical copies within the applicable statutory timeframe.

6. Abusive, Fraudulent, or Prohibited Content

MyEMemorial may review and remove content or restrict accounts involving fraud, impersonation, harassment, threats, hate, sexually explicit material, malicious personal information, malware, spam, deceptive memorials, or other activity prohibited by our Terms of Service.

Where appropriate, MyEMemorial may also restrict contributor access, unpublish a memorial, suspend account access, or take other reasonable steps to protect users and the platform.

7. Temporary Restriction or Removal

MyEMemorial may temporarily unpublish, restrict, or disable access to content while a complaint, ownership dispute, legal issue, security concern, or other investigation is being reviewed.

Temporary restriction does not necessarily mean that MyEMemorial has determined that a violation occurred.

8. Information to Include in a Removal Request

To help us review a request efficiently, please include, when applicable:

• Your name and contact information
• Your relationship to the person or memorial involved
• The memorial name and page URL
• A description of the specific content at issue
• The reason you believe the content should be removed
• Any documentation supporting your identity, authority, or rights, when relevant

Please do not send highly sensitive documents unless requested by MyEMemorial. If additional verification is needed, we will explain what information is required.

9. Review Process

Content-removal requests are reviewed individually. MyEMemorial may contact the requester, memorial owner, contributor, or other relevant party for additional information.

Depending on the circumstances, MyEMemorial may remove content, restrict access, leave the content in place, request additional documentation, or take another action consistent with our policies and applicable law.

MyEMemorial reserves the right to determine whether content violates its policies, while recognizing that certain disputes may ultimately need to be resolved by the parties or through the appropriate legal process.

10. Emergencies and Immediate Safety Concerns

If content presents an immediate threat to someone's safety or involves suspected criminal activity, contact the appropriate emergency or law-enforcement authorities in addition to contacting MyEMemorial.

MyEMemorial may preserve relevant information or cooperate with valid legal requests as permitted or required by law.
