1. Information We Collect

MyEMemorial collects information you provide when you create an account, create or manage a memorial, purchase a plan, give or receive a gifted memorial, submit a contribution, contact us, or otherwise use the service.

Information may include:

• Name, email address, and account information
• Billing and transaction information
• Gift purchaser and recipient names, email addresses, personal messages, delivery information, and gift claim information
• Memorial names, dates, life stories, obituary information, family history, and family-tree information
• Places lived, places worked, schools attended, awards, social media links, and related biographical information
• Cemetery, final resting place, burial, cremation, and location information
• Headstone and memorial marker photographs
• Photographs, videos, audio, favorite songs, and captions
• Contributor names, email addresses, messages, photographs, videos, corrections, and other submissions
• Backup-person contact information and information associated with authorized backup access
• Information associated with Living MyEMemorials created for living individuals
• Communications you send to MyEMemorial, including support, billing, copyright, and content-removal requests

We may also automatically collect technical and usage information such as IP address, browser type, device information, pages visited, referring pages, approximate geographic information, interactions with the service, and traffic or performance data.

2. How We Use Information

We may use information to:

• Create and maintain user accounts
• Create, store, manage, and display memorials
• Provide Living MyEMemorial features
• Provide backup-person and after-death access features
• Process memorial gifts and gift claims
• Process payments, upgrades, and additional media purchases
• Deliver transactional and service-related emails
• Notify memorial owners about contributor submissions and other account activity
• Provide customer support
• Improve the platform and user experience
• Measure website and campaign performance
• Display relevant local advertisements
• Estimate general location, including ZIP-code-level location, when needed for local advertising or service functionality
• Monitor traffic, media usage, and platform performance
• Detect fraud, abuse, excessive bandwidth, or security risks
• Enforce our Terms of Service and other policies
• Comply with legal obligations and lawful requests

3. Public and Private Memorial Information

Memorials created for individuals who have passed away may be made publicly accessible when published by the memorial owner. Information included in a public memorial may be viewed by other visitors to MyEMemorial.

Living MyEMemorials created for living individuals are intended to remain private or unpublished while the person is living, except where the memorial owner intentionally uses a feature that makes specific information available to others.

Users should carefully consider what personal information they choose to place in a public memorial. Public content may be viewed, copied, shared, or indexed by third parties outside MyEMemorial's control.

4. Payments

Payments are processed through third-party payment providers, including Stripe. MyEMemorial does not directly store complete payment card numbers or full card-security information on its own servers.

We may retain transaction information such as purchase type, amount, payment status, plan selected, transaction identifiers, and dates for accounting, customer service, fraud prevention, and legal compliance.

5. Service Providers and Third Parties

MyEMemorial uses third-party service providers to operate the platform. Depending on the feature used, information may be processed by providers that support:

• Website hosting and application delivery
• Database storage, authentication, and file storage
• Video processing, hosting, and streaming
• Payment processing
• Email delivery
• Website analytics
• Advertising measurement and campaign attribution
• Security, monitoring, and technical operations

Current providers may include services such as Supabase, Mux, Stripe, Vercel, Google Analytics, and Meta advertising tools.

These providers may process information only as necessary to provide their services to MyEMemorial and are subject to their own privacy and security practices.

6. Sharing of Information

MyEMemorial does not sell personal information to advertisers or other third parties.

We may share information:

• With service providers as reasonably necessary to operate the platform
• With memorial owners when contributors submit content for review
• With gift recipients or purchasers as necessary to process and deliver a gift transaction
• When you intentionally publish or share information through a memorial
• When required by law, court order, subpoena, or other lawful government request
• When reasonably necessary to investigate fraud, abuse, security threats, or violations of our policies
• In connection with a business transfer, restructuring, or sale, subject to applicable law

7. Contributor Information

Family members, friends, and other contributors may submit written memories, photographs, videos, corrections, or other information to memorial owners.

Contributor information and submissions may be shared with the memorial owner so the owner can review, approve, reject, or manage the submission.

8. Gift Information

When a memorial plan is purchased as a gift, MyEMemorial may collect and use the purchaser's and recipient's names, email addresses, gift type, plan information, personal message, delivery timing, payment status, claim information, and related transaction records.

This information is used to process the purchase, send gift notifications and confirmations, allow the recipient to claim the gift, provide customer support, and prevent fraud or misuse.

9. Backup-Person Information

A Living MyEMemorial owner may provide information identifying a backup person. MyEMemorial may use this information to support authorized backup access and after-death memorial transition features.

MyEMemorial may retain information relating to backup access, authorization attempts, and account activity for security, fraud-prevention, and dispute-resolution purposes.

10. Cookies, Analytics, and Advertising Technologies

MyEMemorial may use cookies, pixels, local storage, and similar technologies to provide site functionality, remember settings, measure traffic, understand how visitors use the service, and evaluate advertising campaigns.

We use analytics tools such as Google Analytics and may use Meta advertising technologies such as the Meta Pixel. These services may receive information about your browser, device, IP address, pages visited, actions taken on the site, and advertising or referral information.

Advertising and analytics providers may use cookies or similar technologies according to their own privacy policies and settings.

11. Local Advertising and Approximate Location

MyEMemorial may use approximate location information, including information derived from an IP address or ZIP code, to determine whether local advertisements or sponsored content are relevant to a visitor.

We do not use this feature to determine a visitor's precise physical location.

12. Data Storage and Security

MyEMemorial uses reasonable administrative, technical, and organizational measures intended to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

No website, database, storage service, or internet transmission can be guaranteed to be completely secure. MyEMemorial therefore cannot guarantee absolute security.

13. Data Retention

MyEMemorial may retain account information, memorial content, transaction records, contributor records, gift records, backup access information, support communications, and technical logs for as long as reasonably necessary to provide the service, maintain memorials, comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

Deleted information may remain temporarily in backups, logs, or systems used for security, disaster recovery, legal compliance, or technical operations.

14. Your Choices and Requests

Depending on your relationship to the information and applicable law, you may request correction, access, deletion, or removal of certain personal information or content by contacting MyEMemorial.

Some information may need to be retained where required for legal, security, fraud-prevention, payment, recordkeeping, dispute-resolution, or other legitimate purposes.

Public memorial content may also be subject to memorial ownership, contributor, family, estate, copyright, or other legal rights that may affect whether a requested change can be made.

15. Children's Privacy

MyEMemorial is not intended for use by children under 13, and we do not knowingly collect personal information directly from children under 13 through account registration.

Memorial owners or family members may include historical or family information concerning minors as part of a memorial or family tree. Users are responsible for ensuring they have the right to submit that information.

16. Legal and Safety Disclosures

MyEMemorial may preserve, review, or disclose information when reasonably necessary to comply with law, respond to legal process, protect users or the public, investigate fraud or abuse, enforce our Terms of Service, or protect the rights, property, or security of MyEMemorial.

17. Changes to This Privacy Policy

MyEMemorial may update this Privacy Policy from time to time. The "Last updated" date at the top of this page identifies the most recent revision.

When changes are material, we may provide additional notice where appropriate.
